What the handoff should contain

The file should identify the client or rightsholder, the authority to act, the work, publication history, registrations if any, observed uses, relevant URLs, evidence collection history, licence research, communications, recipient responses, deadlines and unresolved factual issues.

A concise executive summary should link to the underlying documents rather than substitute for them.

Registration and remedy questions

For U.S. copyright matters, registration status and timing can affect litigation procedure and the availability of statutory damages and attorney’s fees. Counsel should verify the registration record, claimant, effective date, work coverage and timing of the alleged conduct.

Atlantic should not promise particular damages, fees or standing based solely on a registration number.

Privilege and confidentiality

Sending information to Atlantic does not automatically create attorney-client privilege. Privilege depends on the parties, purpose, jurisdiction and engagement. When counsel directs work, the scope and confidentiality instructions should be documented.

Sensitive material should be minimized, access-controlled and shared only with authorized recipients.

Litigation holds and lawful process

Once litigation is reasonably anticipated, counsel may advise preservation obligations. Atlantic can preserve designated records and suspend routine deletion when instructed, but legal-hold scope should be determined by qualified counsel.

The company should respond appropriately to valid subpoenas, court orders and governmental requests while protecting confidentiality and asserting lawful objections where available.
