Valuation methodology and amount continuity

How reviewed amicable resolution amounts are documented, fixed in each piece of correspondence and changed only when a documented development has been approved by a person.

No automatic increase merely because time passes

Once a financial amount has been communicated, it remains the default reference for later correspondence. A subsequent proposal may differ only where a factual, valuation or monetary change has been documented and expressly approved by a person. Earlier correspondence is never altered.

01

Nature of the amount

The amounts shown here are the amicable resolution terms reviewed by Atlantic Image Defense for the identified case. The correspondence records their basis, currency and continuity. A verifiable licence, authorization, invoice or material factual correction may be submitted for review and may change the assessment of the case.

02

Amount frozen in each correspondence

When financial correspondence is generated, the amount, currency, valuation basis and relevant reference information are fixed in that document record. Later approved changes to valuation or reference rates do not alter the historical PDF or the amount originally stated in it.

03

Continuity between correspondence

Once a financial amount has actually been sent, that amount and its currency become the default baseline for subsequent financial correspondence. A recalculation may produce a new recommendation for review, but it does not replace the communicated baseline without notice.

04

When a revision may be considered

A revision may be considered when the documented basis changes materially, for example because of additional verified observations, a longer duration established through repeated observations, a change in the verified technical availability of the identified resource, a different documented valuation reference or a recorded reference-currency conversion. The passage of time alone is not considered sufficient reason for an increase.

05

Currency and reference rates

When a reference amount is converted into another currency, the system records the rate and date used for that correspondence. Once a financial amount has been communicated, later routine exchange-rate movements do not change it automatically. Any monetary revision is reviewed and approved in the same way as other revisions.

06

Human approval and traceability

If a newly calculated recommendation differs from an amount already communicated, an authorized administrator must compare the previous amount, the new recommendation and the underlying case record, give a written reason and expressly approve the change before it can replace the current case amount. That approval is recorded in the audit trail.

07

What the next correspondence shows

If the amount remains unchanged, the valuation explanation records its continuity with the previous financial correspondence. If an approved revision is used, the new correspondence states the previously communicated amount, the newly reviewed amount and the reason approved by a person.

08

Historical integrity

Previous PDFs, dispatch records, evidence and correspondence histories remain unchanged. A later revision creates a new documented state without altering anything that was sent earlier.

Licence, correction or question

If you have received case correspondence and believe the recorded facts, licence status, duration, recipient identity or valuation basis is incomplete or incorrect, use the secure case portal identified in that correspondence or contact copyright@atlantic-image-defense.com. Any material correction is reviewed before further action is taken.

Are you a photographer, an authors’ representative or an image distribution platform? Copyright in a photograph arises when it is created and belongs to its author from the outset, with no formalities. Registration is not a condition of protection: in the United States (17 U.S.C. §§ 102(a), 201(a) and 408(a)); in the more than 180 states party to the Berne Convention, across the Americas, Europe, Africa, Asia and Oceania (Art. 5(2)); in the member countries of the World Trade Organization, which must apply these rules under the TRIPS Agreement (Art. 9(1)), or in those that have joined the WIPO Copyright Treaty (Art. 3).

Registration with the U.S. Copyright Office becomes useful, or even necessary, in specific cases: for a U.S. work, it is required before any action in federal court (§ 411(a)); a registration application is required to bring a claim before the Copyright Claims Board (§ 1505); made before the infringement or within three months of publication, it makes statutory damages and attorney’s fees available (§ 412); made within five years of publication, it creates a presumption that the copyright is valid (§ 410(c)).

ATLANTIC IMAGE DEFENSE can be mandated for either service, each handled separately: defending your photographs, which always begins with an amicable approach to the user; registering your works, carried out directly with the U.S. Copyright Office under a mandate signed beforehand, within that office’s own timeframes. ATLANTIC IMAGE DEFENSE is not affiliated with the Copyright Office or the CCB. Register a work with the U.S. Copyright Office

In the United States, copyright in a photograph generally lasts for the author’s life plus 70 years (17 U.S.C. § 302(a)); the Berne Convention sets a minimum of life plus 50 years (Art. 7(1)), which the WIPO Copyright Treaty extends to photographs (Art. 9).
