1. Operator and scope
Atlantic Image Defense LLC ("Atlantic") operates the website and platform as a technical, administrative, evidentiary and licensing-support service. These terms apply to visitors, account holders, contributors, rights holders, recipient-portal users and any person submitting information. Mandatory local law prevails where it cannot lawfully be waived.
2. No law-firm relationship
Atlantic is not a law firm, court, public authority or collection agency and does not provide jurisdiction-specific legal advice. Factual review, evidence organization, licensing communication and legal handoff support do not create an attorney-client relationship.
3. Informational nature of detections
Similarity results, automated detections, metadata, screenshots and public-source records are indicators requiring human review. They are not final findings of infringement, ownership, liability, damages or identity.
4. Account eligibility and authority
You must be legally capable of entering the relevant agreement and must provide accurate identity and authority information. A person acting for a company or rights holder represents that they have authority to bind or represent that person for the submitted purpose.
5. Credentials and account security
Credentials and private case links are confidential. Users must use strong passwords, protect access codes, promptly report suspected compromise and must not share access except with an authorized adviser or representative.
6. Lawful and accurate submissions
Information, images, documents and communications must be lawful, relevant, complete and accurate to the best of the submitter’s knowledge. Forged evidence, impersonation, malicious uploads, knowingly false notices and unlawful personal-data disclosure are prohibited.
7. Platform availability and changes
Atlantic may maintain, secure, update, suspend or discontinue functions when reasonably necessary. Service levels, quotas, trial rules, paid services and third-party dependencies may be governed by a separate plan, order or written confirmation.
8. Intellectual property in the platform
The software, design, text, branding and platform materials are protected. No ownership in submitted images is transferred merely by upload. Limited technical copies may be made only as necessary to deliver the agreed service.
9. Third-party services and links
Search providers, hosting, email, payment, cloud, legal and technical services may have their own terms and availability. Atlantic is not responsible for independent third-party content or decisions, but selects and manages providers in accordance with applicable obligations and reasonable security practices.
10. Suspension and termination
Atlantic may restrict or terminate access for security risk, non-payment, abuse, unlawful conduct, material breach, inaccurate authority claims or legal requirement. Where appropriate, Atlantic may preserve necessary records and provide a reasonable opportunity to correct an issue.
11. Disclaimers and limitation
Services are provided with reasonable professional care but without a guarantee of detection, removal, payment, settlement, enforceability or litigation outcome. Liability exclusions apply only to the maximum extent permitted by applicable law and do not exclude liability that cannot lawfully be excluded.
12. Governing framework and disputes
Unless a mandatory rule or specific written agreement requires otherwise, New York law governs the contractual relationship, without depriving consumers or data subjects of mandatory protections in their place of residence. Parties should first attempt a documented good-faith resolution; urgent relief and competent-court remedies remain available.
13. Authority verification before protected action
Atlantic may require a signed personalized declaration and supporting rights or authority evidence before relying on a contributor instruction, opening or advancing a sensitive matter, issuing controlled correspondence or presenting a claim as verified. Missing, inconsistent or disputed evidence may result in read-only access, suspension of case activity, a request for further information or closure without a finding against any third party.
